January Meeting

The next meeting of the Constitution Party of Adams-Benton-Franklin Counties will be held on Saturday, January 8th, 10 a.m. - noon, at the Kennewick Library on Union Street.

We will be planning future events, making plans for hosting the Constitution Party State Spring Committee Meeting to be held in Kennewick on April 16, kicking around fundraising ideas and as always, enjoying great discussion along with our coffee and cookies!

On behalf of the leadership of the Constitution Party of Washington...

Dear Constitutionalists;
There has been a lot of concern lately about the results of the Top-Two Primary.  Many people around the state are unhappy with the choices available to them in the general election.  The Constitution Party of Washington has addressed this by spearheading the 2010 Write-In Protest Campaign, which we feel is an option for disenchanted voters to still make their voice heard.  The 2010 Write-In Protest Campaign flyer (click here to view) has been developed to explain the options of a write-in campaign, as well as provide you an easy way to spread the word.  Feel free to download, print, and distribute as you see fit, including emailing it to everyone you know who may be interested.
 What We Are Doing At The State Level
  • We have developed this flyer to help educate people about write-in balloting.
  • We have contacted the 3rd Party Coalition of which we are a member party, and many of them are on board with us and are willing to promote the idea of a write-in protest campaign.
  • We are sending a statewide media release about this campaign.
  • We are asking you to discuss the idea and, if you find it has merit, to distribute flyers to everyone you know.
 What Difference Will This Make?
As far as changing the outcome of the election, it will have no effect.  What it will do is send a clear message as to the number of disaffected voters in the state.   The total number of under-votes will show how many people did not like the choice placed before them.  We can use these numbers to work towards improving the election system in our state by changing the Top-Two Primary.  The results of choosing to participate in the 2010 Write-In Protest Campaign will be long term but essential to showing the need to create an equal access election system that no longer denies large segments of the voting population a voice in the general election.  We believe this is ultimately the denial of the First Amendment right to Free Speech in the political arena.
 Only You Can Make the Difference
Only you, the average citizen, can change the system by thinking outside the box built around us by the two-party system, which has evolved in this country, in opposition to the party-free system designed by the Founding Fathers.  Only you, the average citizen, can vote your conscience.   Only you, the average citizen, can stand up and say, “No more” to the encroaching centralized control of the federal government.  No longer do our Representatives truly represent us, nor do our Senators truly represent the interest of our State.  Rather, they represent the interests of the party which they serve.  The 2010 Write-In Protest Campaign is just the beginning of many small battles that need to be won before the People can restore the Republic we are guaranteed by the Constitution of the United States.

It's Here! It's Here! The New Republican Pledge to America is Here!
(a critical review from a Constitutional perspective)

So does the Republican's new “Pledge to America” make you want to jump for joy, run up and down and shout? Well that's what it's supposed to do – at least that's the effect the Republicans are hoping it will have on conservatives. However, it doesn't really affect me that way, but then I'm not a conservative. I'm a Christian and a Constitutionalist and I just can't quite buy into the Republican's attempt to repackage and sell themselves to the voting public as fiscally responsible proponents of smaller government and defenders of the Constitution.
I admit that the pledge itself is chock full of conservative rhetoric and at times even sounds downright Constitutional. However, after seriously analyzing it, I find the Pledge to America to be weak. While it offers some modest relief from oppressive taxation and burdensome regulation, it misses the opportunity to call for the revolutionary reforms that would restore real freedom and true Constitutional governance: ending the Federal Reserve, restoring Constitutional money, eliminating direct federal taxation on wages, getting out of the United Nations, dismantling every department and agency not clearly authorized under the Constitution, declaring every restrictive gun law passed by Congress null and void for lack of Constitutional authority, deporting millions of illegal aliens . . . . and the list goes on.
The document itself is only part of the matter at hand. The other half of the equation is the integrity and track record of those offering the pledge. The Pledge to America is being presented to us by a group of people who have already had the chance (most of them have already been in Congress awhile – a long while) to do the things promised in the pledge during the six years that their party controlled both Congress and the White House – but they chose not to. In fact, not only did they choose not to do or even try to do these things when they had the chance, they actually did many of the things that this pledge now condemns Democrats for doing over the last two years.
To give it a fair shake, let's look at the pledge itself and give it a review. The pledge is actually a 48 page document titled “A Pledge To America” and contains 7,399 words. To put it in perspective, the main body of the U.S. Constitution (excluding amendments) is 4,485 words. The portions of the document making actual pledges, that is, “we will . . ,” account for approximately 1,494 words, though much of that is the restating of the same pledges in different sections of the document. So what do they do with the other 6,000 or so words? Well, mostly they blather on and on about Democrats being the root of all evil and Republicans being paragons of conservative and Constitutional virtue.
Health Care and The Constitution
I would say the two best, and potentially most impacting pledges in the document, are the pledges to “require each bill moving through Congress to include a clause citing the specific constitutional authority upon which the bill is justified” and the pledge to “repeal President Obama’s government takeover of health care.” Now that's good stuff! However, even here I'm having a problem. You see, the document goes on to pledge to “replace it (the health care law) with common-sense reforms.” Excuse me, but how about if we repeal the health care law and replace it with exactly what the U.S. Constitution calls for – ABSOLUTELY NOTHING!
Given that they pledge to require every bill in Congress to cite 'specific constitutional authority,' then I have to ask exactly where in the U.S. Constitution do they find authorization for their pledges
  • “Ensure access for Patients with Pre-Existing Conditions.”
  • “Expand state high-risk pools . . .”
  • “Make it illegal for an insurance company to deny coverage to someone with prior coverage on the basis of a pre-existing condition . .”
  • “Eliminate annual and lifetime spending caps, and prevent insurers from dropping your coverage just because you get sick.”
  • “Incentivize states to develop innovative programs that lower premiums and reduce the number of uninsured Americans.”
I'm sorry, but none of this stuff is in my copy of the U.S. Constitution.
For those who may have missed it, that last item in the above list begins with the word “incentivize.” In 'government speak,' the word incentivize means to first strip revenue out of a state, then offer the money back to the state, but with strings attached, so that in order for a state to get back the funds that the federal government took from their citizens in the first place, the state now has to become the federal government's 'puppet on a string' and dance to their tune. This makes a mockery of federalism as established under our Constitution and especially insults the 10th Amendment. Oh, did I mention that the Pledge to America also states:
“We pledge to honor the Constitution as constructed by its framers and honor the original intent of those precepts that have been consistently ignored – particularly the Tenth Amendment, which grants that all powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.”
Tax Relief
Tax relief is one of the big selling points of the Pledge to America. While the casual observer may get the impression that Republican's want to slash taxes, in reality, their plan calls for one tax cut for small businesses (a deduction equal to 20 percent of their business income) and a pledge to retain the 'Bush tax cuts' of 2001 and 2003 which are due to expire next year. Beyond these two items, there are no other pledges to actually reduce taxes – for that matter, there is no specific pledge not to raise other taxes or adopt new ones.
Regarding the sunset of the tax cuts, the pledge states that “Unless action is taken, a $3.8 trillion tax hike will go into effect on January 1, 2011.” What the plan fails to point out is that Democrats also want to retain $3.1 trillion worth of those tax cuts. The actual debate is over the remaining $700 billion in tax cuts for individuals making over $200,000 per year. The plan additionally fails to point out that the tax savings would be realized over a 10 year period.
In other words, the grand and benevolent gesture of tax relief being offered by the Republicans (above what Democrats already plan to do) is to allow taxpayers (who make over $200,000) to realize a savings over the next 10 years that is equal to the amount that many of these same Republicans helped President Bush dump into the coffers of the Wall Street banksters in just one month in October of 2008. When you consider that American's pay more in taxes than we pay for food, clothing and shelter combined, the Republican's attempt to buy our vote with a savings of $700 billion over ten years becomes downright insulting.
As for the 20% deduction for small businesses, the founders of our republic never intended for the federal government to be taxing my neighbor's plumbing business in the first place.
Spending Reduction
The only specific pledges of reduced spending are:
  • “We will roll back government spending to pre-stimulus, pre-bailout levels, saving us at least $100 billion in the first year”
  • “We will cancel the Troubled Asset Relief Program (TARP), a move that would save taxpayers tens of billions of dollars” (seems only fair seeing as it's un-Constitutional to begin with)
  • “We will reform Fannie Mae and Freddie Mac . . . This will save taxpayers as much as $30 billion.” (again, I have to ask, where's the Constitutional basis for being involved with Fannie and Freddie at all?)
That's a grand total savings of $130 billion, plus possibly “tens of billions?” To put it in perspective, if we were to be generous and assume a $150 billion decrease in annual spending based on these promises (though some of this would likely be a one time savings or be spread over a number of years), it would be a savings equal to 4.2% of the federal government's $3.55 trillion budget for 2010, or a 13% decrease in deficit spending, meaning that in the future we would only be racking up about $1 trillion a year in new debt compared to the current $1.17 trillion – now that' fiscal conservatism.
There are various other pledges made that I won't go into detail about. Suffice it to say they are of less significance than the items covered here and generally more subjective in nature and thus would be harder to track or document the performance of. If all the pledges in the document were performed, I expect we would notice a difference in our government and in our way of life, but the difference would be a small one in comparison to what actual Constitutionally limited government would look like and the affect that would have on our lives.
The lion's share of the document is actually devoted to listing all that is wrong and blaming the Democrats for it, either directly or by inference, calling them “big spenders” and alluding to “self-appointed elites.” A few of my favorite excerpts include:
  • Washington’s out-of-control spending spree needs no introduction.
  • Instead of putting the brakes on Washington’s spending habits as they promised, President Obama and Democratic Leaders have stepped on the accelerator.
  • Democrats refuse to listen to the American people and eliminate, restrain, or even budget for their out-of-control spending spree.
Wow, were these guys looking in the mirror when they said this stuff? I can't believe they are saying it with a straight face. This is coming from Republican's who controlled Congress and the White House from 2000 to 2006 and during that time gave us record spending, record deficits and record debt. They presided over the printing of untold trillions in fiat currency, the subsequent devaluing of the dollar and the continued destabilizing of the economy. They were consenting to policies that allowed for the continued exporting of jobs and the importing of illegal aliens who took what jobs were left. I don't like to call anyone names, but the word 'hypocrisy' keeps coming to mind.
Look, I'm not saying that “the Republican's are all evil, so run out and vote for Democrats.” What I am saying is, that as for me, I cannot let myself be moved by every new public relations ploy of the political establishment. I can not, and will not, give the precious virtue of my vote to any candidate for public office who does not demonstrate to me an understanding of, and commitment to, the God given role of civil government and the strict limits placed on it by the clear and simple text of the U.S. Constitution.
The Republicans would do better to actually demonstrate adherence to the U.S. Constitution and discipline to sound fiscal policy before asking the public to vote for their candidates. Then they wouldn't need a 'pledge' promising to start doing now what they haven't done in the past.

WRITE-IN Protest Campaign

The leadership of CPWA has been hearing a sense of frustration among voters at the choices left to us by the Top Two Primary system in many races across the state. We have been asked a lot of questions about a “Write-in Protest Campaign”. Here are some answers to those questions:

-Can a candidate who ran for public office in the Primary election run as a write-in candidate for the same office in the General Election? NO

-Can a candidate who ran for public office in the Primary election run for a different office as a write-in candidate in the General Election? YES

-Does a candidate have to reside in the district in which they wish to run for office as a write-in candidate? Yes and No. A candidate for a State office must reside within the district for which they wish to run. A federal candidate must only be an “inhabitant” of the state for which they wish to run.

-What is an “official” write-in candidate?
An “official” write-in candidate is one who has filed the appropriate paperwork with the Secretary of State’s office, and has paid the filing fee.

-What is an “unofficial” write-in candidate? An “unofficial” write-in candidate is someone whose name is written in without filing the appropriate papers or paying the filing fee with the Secretary of State’s office.

-Are write-in votes recorded?
Yes and No. They are not recorded by the name of the candidate unless the number of votes received can change the outcome of the race. They are recorded as an “undervote”.

-What is an “undervote”?
An “undervote” occurs whenever no one is selected in a particular race. For example: Alien vs. Predator. Conscientious objectors to such a choice might choose to not mark for either candidate or to write-in "none of the above", or write-in the name of an “official” write-in candidate, or write-in the name of an “unofficial” write-in candidate, something entirely different. This is tabulated as an “undervote” and will be noted in the statistics as such.

-What if more than one candidate is marked in any given race?
This is called an “overvote” and is tabulated as such. In this case no vote is given to any candidate in that particular race.

-What about the phrase, “None of the Above”, as a write-in vote?
A write-in of “None of the Above” is tabulated as an “undervote”. Some states have this written into their election law as a viable option that can force a special election in a particular race should the “None of the Above” option reach 51% or more, but is not available to voters in the State of Washington.

-How does a voter write a write-in vote so it counts as a vote for a particular candidate should the numbers of votes for that candidate meet the threshold requirement for tabulation?
If the candidate has NOT filed as a write-in, then he must receive votes which are clearly and definitely for the same person in order for those votes to count. Write-ins must also receive more votes than either of the printed names before the election officials will look at the write-in names. Any write-in campaign should let the public know how to correctly write-in the name so it appears correctly and consistently on all ballots.

If you desire to participate in a WRITE-IN Protest Campaign, remember the following things:
-Everyone must write in the exact same name, spelling counts! For example,
o None of the above
o Randall Yearout
o Mary Ruth Edwards
o Clint Didier
-Unless your “write-in” attains enough votes to change the outcome of the race, it will be counted as an “undervote”, but that is an indicator of voter displeasure with the choices before them and we will make use of those numbers.
-This will only work if we get a sufficient number of voters to understand the process and to actively participate in the process.

Always REMEMBER!

9 years ago I watched, live, as events unfolded in NYC, from the second plane strike to the complete destruction of the Twin Towers. My emotions are still raw, and easily come to the surface when I consider the ramifications of that fateful day.

Seeing the terror on the faces of those running for their lives as the towers came down, watching helplessly as people jumped from windows to escape the inescapable. I remember being very thankful that my employer sent me home that day, not knowing whether the public schools would be sending our children home early, closing or for how long. Feeling a fresh stab of fear every time I saw or heard a fighter jet overhead. Even now, when the jets fly over my school on their weekly practice runs, I feel uneasy and wonder, "Is this just another practice run, or...?"

Will we ever heal? Or will we conveniently forget so that we can stop feeling uncomfortable as the names are read in memorium each year?

We must NEVER FORGET! ALWAYS REMEMBER that WE are the citizens of the UNITED STATES OF AMERICA! We must not live in fear, but boldly show the world that Americans will not be kowtowed, that Americans have the wherewithal and temerity and strength of purpose to live our lives in FREEDOM and LIBERTY!

The way to ensure our freedom and liberty is to elect constitutionally-committed public servants who listen to the will of the people, and who will enact laws that do not infringe on our liberties but serve to enhance our freedom by limiting government to its constitutional boundaries.

We are having an activist training day on Sat Sept 25th. Dr. Bob Basso is scheduled to be our key note speaker. He will kick off the event speaking on how to strengthen your organization. We have additional conservative activists from WA to work with us in break out sessions on long term strategies for success, get out the vote, navigating the government and how to read bills and testify. It should be a great day (9 - 4:30). We will end with Bob Basso portraying Thomas Paine - A Triumph of Principles. November, here we come!

Changing gears

This time last month I was in the final days leading up to the Top 2 primary election.  One year ago, I took on the responsibility of Benton County Coordinator for the Constitution Party, but when I decided to run for office those duties got put on the back burner.

Well... as most of you are aware, I received just over 3% of the vote which wasn't enough to get me to the general election in November.  Which, on one hand, is disappointing, but on the other hand, I'm able to really focus on growing the Constitution Party in Benton County!  Perhaps this is the silver lining?

Although I have returned to teaching, my evenings I'm devoting to either facilitating Institute on the Constitution courses in Prosser and Kennewick, or researching events to promote Constitution Party awareness.

If you have ideas of events at which it would be appropriate to promote the principles of the Constitution Party,  please let me know.  If you hear of a gun show, or rally, or farmers market event, let me know.

Upcoming Institute on the Constitution courses

In the next few weeks I will be giving classes in Prosser and the Tri-Cities on the Constitution as law and the Constitutional Republic as the form of civil government our Founding Fathers established. It is called the Institute on the Constitution. It consists of twelve 30-minute lectures on DVD by John Eidsmoe. There will be ample time for questions, discussion and tests (and maybe a few good disagreements) we have compiled from past classes and provided in a Student Manual. I will be your course facilitator and general encourager as we banish ignorance from ruling over us and recover the truth that sets us free.

We will meet in the Kennewick Library large conference room beginning on Friday, October 8th, from 6:00-8:00 p.m. This will be a six-week course, which will necessitate two 30-minute lectures each week.

Kennewick Schedule: All classes are at Kennewick branch, Mid-Columbia Library. Some dates are listed as tentative only because the Kennewick library will not schedule more than two weeks in advance. however, they assure me that it is very likely that this schedule will hold.

In late October, an Advanced Institute on the Constitution will be offered for those who have already completed the original course and are interested in deepening their knowledge of the development of ideas and principles used by the Founding Fathers in crafting this astounding document. Another session of the advanced course will be offered in early 2011.

We have had an increased number of requests from the many now beginning to realize We the People need to understand the rules for living in a civil society.

The course is free. Student manuals are optional and cost $35, which is what it costs me for duplication. Having said this, no one will be denied due to lack of funds. Provision will be made. George Washington has expressed our sentiment precisely:

"Truth will ultimately prevail where there is pains taken to bring it to light."

Please contact me ASAP if you will be attending, and at which location. Remember in your consideration the words of Edmund Burke:

"All that is necessary for evil to triumph is for good men to do nothing."

I am also open to conducting this course at a free venue near you…be it at a church, or in a private home group setting. Please let me know if you would like to discuss these alternatives.

About John Eidsmoe

Dr. Eidsmoe holds degrees in law, theology, and political science and is licensed to practice law in several States. Currently, John works for the Alabama Supreme Court as a constitutional attorney and consultant. He is also involved in Judge Moore’s campaign for governor of Alabama. A practicing attorney, he has successfully argued constitutional issues before several state Supreme Courts. In addition to speaking at seminars around the U.S., Dr. Eidsmoe serves as Lt. Colonel in the U.S. Air Force Reserve and on the national Board of the Plymouth Rock Foundation. In 1973 and again in 1988, Professor Eidsmoe received the George Washington Honor Medal presented by the Freedom Foundation at Valley Forge, PA. John is the author of twelve published books on historic constitutional and religious topics. Just for fun, John is a state champion karate master and he rides horses every chance he gets.
